Terms of Use

1. The agreement

These Terms are an agreement between you and Zone Tag V.O.F., KvK 98283863, registered at Hobbemalaan 194, 1816 GH Alkmaar, Netherlands ("Zone Tag", "we", "us").

By using the Zone Tag app you accept these Terms. Supported app versions also ask you to confirm the content rules before your first upload. If you do not accept these Terms, do not use the app or submit content.

Our Privacy Policy explains what data we handle and forms part of this agreement.

2. Who may play

If you organise a game that includes players under 16, you are responsible for having that permission and for supervising the game.

3. Playing safely in the real world

This is the most important section on this page, so please actually read it.

Zone Tag sends you walking, and sometimes running, through a real city. Your phone shows you where to go. It does not know about the tram, the canal, the cyclist behind you or the kerb in front of you. You are responsible for your own safety and for the safety of the people around you at all times.

Concretely, you agree that you will:

• Look up. Do not walk while staring at your screen. Stop, look, then walk.
• Obey traffic rules. Cross at crossings, wait for the light, do not run into the road. Never play while driving, cycling or riding a scooter. If you are the one moving the vehicle, the phone stays in your pocket.
• Respect private property. Zones are drawn in public space. Do not enter private land, gardens, building sites, closed premises, roofs, tunnels, tracks or anywhere you need permission to be. If a challenge seems to ask you to, it does not: skip it and tell your game master.
• Respect the rules of the place you are in. Museums, shops, stations and venues have their own rules. Follow them. Leave when asked.
• Not climb, trespass, damage or take anything. No zone is worth a broken ankle or a repair bill.
• Not play in dangerous conditions. Storms, ice, floods, closed-off areas. Use your judgement and stop when it stops being sensible.
• Watch out for others. Do not run through crowds, do not block doorways or pavements, do not startle people. Other people did not sign up for your game.
• Play sober enough to be safe. If you are too drunk to cross a road safely, you are too drunk to play.
• Know your own limits. Zone Tag involves physical activity for an extended period. If you have a health condition that makes that risky, check with a doctor first and take it easy.

No challenge in Zone Tag ever requires you to break the law, trespass, or take a physical risk. If any challenge looks like it does, it is a mistake or someone has written a bad custom challenge. Do not do it, and report it to your game master or to us.

4. Content rules

When you submit a photo, a video, a text answer, a team name or any other content, you are showing it to your game master and to the other players in your game. These rules apply to all of it. There is zero tolerance here.

• No nudity or sexual content. No nudity, no partial nudity, no sexual acts, no sexually suggestive content, no sexual references in text or team names. Nothing that would be inappropriate on a company outing, because a lot of Zone Tag games are exactly that.
• Absolutely no sexual content involving minors. Any content that sexualises a child in any way results in an immediate permanent ban and a report to the police. There is no warning and no appeal.
• No harassment or bullying. No targeting, humiliating, threatening, intimidating or piling on another person. No content designed to make someone feel unsafe. This applies to players and to anyone else who ends up in your photo.
• No hate. Nothing that attacks or demeans people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or any similar characteristic. No hate symbols.
• No violence or gore. No violent acts, no injuries, no blood, no weapons used as a threat, no content that glorifies or encourages violence or self-harm.
• Nothing illegal. No content that is unlawful, that depicts a crime, that shows or promotes illegal drugs, that infringes someone else's copyright, or that reveals someone's private information without permission.
• Nothing that endangers anyone. No content that shows or encourages dangerous behaviour: trespassing, climbing structures, playing in traffic, stunts.
• No spam or impersonation. Do not submit unrelated content to farm zones, do not advertise, and do not play under someone else's name to deceive people.

You are responsible for everything you submit. You confirm that you have the right to submit it, and that it does not infringe anyone else's rights.

5. Photographing other people

You are in a public space with a camera, so this needs its own section.

• Do not photograph or film people who do not want to be photographed. If someone makes it clear they do not want to be in your shot, stop, delete it, and take a different photo. That is not a negotiation.
• Passers-by in the background of a wide shot are usually fine. Someone recognisable in the centre of the frame who has not agreed is not.
• Never photograph or film children who are not part of your own group.
• Do not photograph through windows, into homes, or into places where people reasonably expect privacy: changing rooms, toilets, medical practices.
• Do not ask a stranger to take part in a challenge in a way that pressures or embarrasses them. Asking politely is fine; a "no" ends it.

If someone appears in a Zone Tag submission and objects, they can write to support@playzonetag.com and we will remove the file.

6. How to behave towards other players

Zone Tag is a chase game, so there is a natural amount of shouting and running. That is the fun part. The line is:

• No physical contact. Tagging in Zone Tag happens in the app, not with your hands. Do not grab, push, tackle or block another player. Ever.
• No taking or damaging anyone's phone or belongings.
• No cornering, trapping, or following someone who has said they are done playing.
• Do not use another player's live location for anything outside the game. The map exists for the game and ends with the game.
• No cheating that undermines the game for others: fake GPS apps, location spoofing, submitting someone else's photo, or using multiple devices for one player.
• Do not attempt to break into, reverse-engineer, overload or otherwise interfere with the app or our servers.

7. Reporting and blocking

If you see something that breaks these rules, you have three routes:

1. Report it in the app. In supported app versions, report the submission that contains the problem. The report covers both the content and the player who submitted it. Tell us briefly what is wrong; reports come to us and we review them.
2. Block the player. Blocking hides that player's submissions from your own view of the game. It works immediately and does not require anyone's approval. It applies to your device only: it does not remove them from the game for other players.
3. Tell your game master. They can reject and remove a submission in their own game straight away, and can remove a player from the game.

You can also email support@playzonetag.com at any time. If the content involves a crime or someone's immediate safety, contact the police first (in the Netherlands, 112 for emergencies and 0900-8844 otherwise) and then tell us.

Do not file false or malicious reports. Doing so is itself a breach of these Terms.

8. What happens if you break the rules

Depending on what happened and how bad it is, we may:

• Remove the content. We can delete any submission that breaks these rules, without notice and without needing anyone's agreement. Game masters can do the same within their own game.
• Reject the submission, so the zone is not captured.
• Remove you from a game.
• Ban you from Zone Tag. For serious or repeated breaches we block the device or installation from joining any game, permanently.
• Report you to the authorities, where the content or behaviour appears to be criminal. For content that sexualises minors, we always do.

We review reports as they come in. If you think we got it wrong, reply to us at support@playzonetag.com and a person will look at it again.

9. If you run a game

Game masters have extra responsibility. If you set up a game, you agree to:

• Only invite people who want to be there, and make sure they know what the game involves, including that their live location is shared with other players.
• Review submissions and remove anything that breaks the content rules in section 4, promptly.
• Not write custom challenges that ask players to trespass, break the law, take a physical risk, drink, or do anything that would break these rules.
• Get permission from parents or guardians for any player under 16, and supervise them.
• Choose a play area that is actually safe to play in.
• Stop the game if conditions become unsafe.

10. Your content stays yours

The photos and videos you submit remain yours. By submitting them you give us a limited licence to store them, show them to the game master and the players in your game, and process them as needed to run the game, nothing more. We do not use your content for marketing or promotion unless you give us separate, explicit permission for that specific content.

You can ask us to delete your submissions at any time; see Delete your data in the Privacy Policy.

11. Our content stays ours

The Zone Tag app, the name, the logo, the maps, the zones and the challenges we write are ours and are protected by intellectual property law. You may use them to play Zone Tag. You may not copy them, republish them, or use them to build a competing game.

12. Availability and changes

We do our best to keep Zone Tag running, but we do not promise it will always be available or bug-free. It depends on your phone, your battery, your mobile signal, your GPS reception and on Google's Firebase platform, and any of those can fail mid-game. We may change, suspend or discontinue features, and we may change these Terms. If a change matters, we will tell you in the app before it takes effect. Continuing to play after that means you accept the new version.

13. Booking a game

A game may be arranged directly with us, through a partner organisation, or through a version of the app that offers a store purchase. Where a purchase is offered by Apple or Google, that store processes the payment under its own payment terms. We do not receive your full payment details.

Cancellation and rescheduling terms for a booking are agreed individually as part of that booking, for example in the quote or booking confirmation. If nothing else was agreed, contact us directly to work it out.

14. Liability

To the fullest extent permitted by Dutch law, we are not liable for:

• Injury, accident, illness or death arising from taking part in a game;
• Damage to or loss of your phone or other belongings;
• Damage you cause to property or to other people while playing;
• Fines or penalties you incur for trespassing, traffic offences or anything else you do while playing;
• What other players do, submit or say;
• Loss of game progress, missed captures, or results affected by GPS inaccuracy, network problems, battery failure or an outage at a service we depend on.

Where we are liable despite the above, our total liability towards you personally is limited to the greatest extent Dutch law allows.

None of this limits our liability for death or personal injury caused by our own intent or gross negligence, or any other liability that Dutch law does not allow us to exclude. If you are a consumer, your mandatory statutory rights are unaffected by anything on this page.

You are responsible for the consequences of your own actions during a game, and you agree to indemnify us against claims from third parties arising from how you played: for example a claim by someone you photographed without permission, or by a property owner whose land you entered.

15. Law and disputes

Dutch law applies to these Terms. Disputes go to the competent court in Alkmaar, unless mandatory consumer rules give you the right to go to a different court.

If any part of these Terms turns out to be invalid, the rest stays in force and the invalid part is replaced by the closest valid equivalent.
